Study about previous topics in relation with the testaments as privileged sources 10 the knowledge of collectives attitudes befare death in Murcia and its municipality in the eigthteenth century. We deal with themes like social and geographic representativity of this document and its character of a source for the study of mentalities, c1asping all the century and applying an aleatory sounding of a homogeneous type of notariate record.

The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each other. The Law (...) is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction. (shrink)

Este articulo investiga el cada vez más frecuente fenómeno de las intervenciones internacionales noviolentas para la transformación de conflictos y, en concreto, analiza los efectos que pueden tener dichas intervenciones sobre la protección y el empoderamiento de los activistas de derechos humanos que viven en situaciones de riesgo por su trabajo en entornos conflictivos altamente violentos. Para ello se situará el contexto en el que han surgido y se han desarrollado estas iniciativas, analizándose los principales elementos que las caracterizan, y (...) se estudiará el caso de la protección que proporciona Peace Brigades International a los defensores de derechos humanos, lo que permitirá extraer conclusiones relativas a las posibilidades que ofrecen las intervenciones internacionales noviolentas a la comunidad internacional en los campos de la prevención de la violencia, la gestión de conflictos y de construcción de la paz. This article introduces and defends the “pathological complexity thesis” as a hypothesis about the evolutionary origins of minimal consciousness, or sentience, that connects the study of animal consciousness closely with work in behavioral ecology and evolutionary biology. I argue that consciousness is an adaptive solution to a design problem that led to the extinction of complex multicellular animal life following the Avalon explosion and that was subsequently solved during the Cambrian explosion. This is the economic trade-off problem of having to (...) deal with a complex body with high degrees of freedom, what I call “pathological complexity.” By modeling the explosion of this computational complexity using the resources of state-based behavioral and life history theory we will be able to provide an evolutionary bottom-up framework to make sense of subjective experience and its function in nature by paying close attention to the ecological lifestyles of different animals. Derek Parfit influentially defends reductionism about persons, the view that a person’s existence just consists in the existence of a brain and body and the occurrence of a series of physical and mental events. Yet some critics, particularly Mark Johnston, have raised powerful objections to Parfit’s reductionism. In this paper, I defend reductionism against Johnston. In particular, I defend a radical form of reductionism that Buddhist philosophers developed. Buddhist reductionism can justify key features of Parfit’s position, such as the claims (...) that personal identity is not what matters and can also be indeterminate. Furthermore, Buddhist reductionism can avoid Johnston’s objections to Parfit’s reductionism. I conclude that reductionists have good reasons to favor Buddhist reductionism over Parfit’s version. A partir de una concepción desprejuiciada respecto de lo marginal, de la fealdad y la miseria, el autor despliega una mirada alterna sobre los espacios de borde en busca de la reivindicación de la miseria, a la vez que relativizar el canon estético que prestigia temas y motivos (...) lejanos al campo de referencia de quienes habitan el borde. La exhibición de aquellos espacios, los personajes y los paisajes minoritarios, su composición plástica y narrativa, sin embargo, dialogan permanentemente con la tradición pictórica de elite. Starting from an unprejudiced conception regarding the marginal, the ugliness and the misery, our author displays an alternate look on the edge spaces in search of the vindication of the misery, at the same time that relativizes the aesthetic canon that prestige subjects and reasons far from the reference field of those who inhabit the edge. The exhibition of those spaces, the characters and the minority landscapes, their plastic and narrative composition, nevertheless, permanently dialogue with the pictorial tradition of elite. En esta circunstancias, creemos que el texto de Cristina Peri Rossi va mutando desde la concepción de la marginación como puro (...) despojo y negatividad, a la asunción del éxodo como instancia de liberación, y por tanto, de superación de las categorizaciones propuestas por el poder. There has been much criticism of the idea that Friston's free-energy principle can unite the life and mind sciences. Here, we argue that perhaps the greatest problem for the totalizing ambitions of its proponents is a failure to recognize the importance of evolutionary dynamics and to provide a convincing adaptive story relating free-energy minimization to organismal fitness.

A reality-design gap in the conceptualization and practice of digital agriculture has been systematically reported in the literature. This condition is favored by the lack of understanding and inclusion of local worldviews around digital technologies. Informed by Amartya Sen’s capabilities approach, this study looks to bring stories of local appropriation to the spotlight. Based on a qualitative approach that included data collected through interviews with 73 households, the authors explored the way in which two selected communities of Colombian coffee growers (...) are engaged in the use of digital technologies in material and symbolic ways. Three emergent themes—a relational way of farming, (dis)connected machines, and nurtured families and communities – articulate multiple interactions between farmers, farms, institutional programs, and technologies, that originate local forms of digitalization (and non-digitalization). This study points out the relevant role of situated ideas of development in positioning technologies in or out of the farm, and broader digitalization agendas in or out of farmers’ life projects. At the same time, it presents a critique of notions of universality that drive unquestioned quests for technification. In contrast, building on a relational perspective, this study calls for embracing a perspective of multiplicity within notions of development and innovation. (shrink)

Background:Stress can frequently occur in the driving context. Its cognitive effects can be deleterious and lead to uncomfortable or risky situations. While stress detection in this context is well developed, regulation using dedicated advanced driver-assistance systems (ADAS) is still emergent.Objectives:This systematic review focuses on stress regulation strategies that can be qualified as “subtle” or “mindless”: the technology employed to perform regulation does not interfere with an ongoing task. The review goal is 2-fold: establishing the state of the art on such (...) technological implementation in the driving context and identifying complementary technologies relying on subtle regulation that could be applied in driving.Methods:A systematic review was conducted using search operators previously identified through a concept analysis. The patents and scientific studies selected provide an overview of actual and potential mindless technology implementations. These are then analyzed from a scientific perspective. A classification of results was performed according to the different stages of emotion regulation proposed by the Gross model.Results:A total of 47 publications were retrieved, including 21 patents and 26 studies. Six of the studies investigated mindless stress regulation in the driving context. Patents implemented strategies mostly linked to attentional deployment, while studies tended to investigate response modulation strategies.Conclusions:This review allowed us to identify several ADAS relying on mindless computing technologies to reduce stress and better understand the underlying mechanisms allowing stress reduction. Further studies are necessary to better grasp the effect of mindless technologies on driving safety. However, we have established the feasibility of their implementation as ADAS and proposed directions for future research in this field. (shrink)

New Critical Legal Thinking articulates the emergence of a stream of critical legal theory which is directly concerned with the relation between law and the political. The early critical legal studies claim that all law is politics is displaced with a different and more nuanced theoretical arsenal. Combining grand theory with a concern for grounded political interventions, the various contributors to this book draw on political theorists and continental philosophers in order to engage with current legal problematics, such as the (...) recent global economic crisis, the Arab spring and the emergence of biopolitics. The contributions instantiate the claim that a new and radical political legal scholarship has come into being: one which critically interrogates and intervenes in the contemporary relationship between law and power. This paper delves into the deconstruction of the notion of responsibility, drawing a correlation with the process of decomposition of the concept of sovereignty as discussed by Derrida in his last research works. We explore Derrida’s consideration of absolute responsibility as no longer passing through the figure of the sovereign. Derrida’s thought takes its distance from the philosophical and hegemonic determination of the notion of responsibility, for the conceptual system of its axiomatic defines responsibility based on the sovereign individual’s freedom (...) and makes responsibility the effect of his power. Yet, this definition condemns ethics to failure, since it does not account for the other supposed in the idea of response. Derrida incorporates absolute singularity, and consequently secrecy, into the structure of responsibility, enabling thought to encounter the absolute other. The text outlines the influence of Nietzsche and Celan in Derrida’s thought and develops an approach that sees in his work the effort to create a poetic revolution in the history of philosophy and knowledge by opening thought to radical alterity. This study aimed to analyze the levels of personal aggression and victimization, ethnic-cultural aggression and victimization, self-esteem, empathy, social skills and gender in adolescents as potential predictors of bullying in Spain and Ecuador. The wide pluricultural sample comprised Secondary Education students from both countries (N = 25190, average age = 13.92, SD = 1.306; NSpain = 14437; NEcuador = 10753), who took part in the study by filling in a self-report. The results revealed that predictive models of bullying for both (...) countries explain 50-70% of variance. A transnational predictive pattern of personal victimization can be observed based on the levels of ethnic-cultural victimization, ethnic-cultural aggression, personal aggression, self-deprecation and affective empathy. A transnational predictive pattern of personal aggression is evidenced depending on the levels of ethnic-cultural aggression, personal victimization, self-deprecation, ethnic-cultural victimization and the fact of being female. We concluded that bullying can largely be predicted by involvement in ethnic-cultural discrimination. These results are discussed, and educational inferences are drawn for prevention. (shrink)

Instead of thinking of ‘public order’ as the type of power that police deploy to manage disorder, this article suggests that we understand it as a set of background affects. The problem of analysing these affects is that (aside from moments of unrest) the majority of the populace is anaesthetised to them. Most people take the public feelings of calm predictability for granted. Crucially, however, the everyday management of public order does not anaesthetise everyone. It also produces ‘suspect populations’, who (...) must remain attentive to its low background hum. This article focuses on the US ‘colony within’ literature, developed by civil rights and black nationalist traditions from the late 1960s. The article suggests that this internal colony analysis contains a nuanced exploration of the spatialised affects of public order; the clouds of suspicion; the atmospheres of tension; and the police encounters that generate an affective substrate of relations. This paper constitutes a radical departure from the existing philosophical literature on models, modeling-practices, and model-based science. I argue that the various entities and practices called 'models' and 'modeling-practices' are too diverse, too context-sensitive, and serve too many scientific purposes and roles, as to allow for a general philosophical analysis. From this recognition an alternative view emerges that I shall dub model anarchism.

This paper presents the outlines of a phenomenological theory of foundational or non-inferential knowledge according to which the facts or states of affairs towards which our beliefs are intentionally directed can sometimes serve as reasons or evidence for what we believe. This occurs in acts of fulfillment, in which an object or state of affairs is given as it is thought to be. Hopp further argues that the sorts of empirical facts that can serve as reasons for noninferentially justified beliefs (...) are not confined to facts about one’s own occurrent mental states, but include facts about the physical world as well. In the course of defending the view against objections, Hopp argues that we should be internalists about the reasons in virtue of which what we believe is justified but externalists about the factors in virtue of which our states of believing have the status of being justified. La locura en Los siete locos es resultado de un intento de integración a la realidad sufrido por los personajes revolucionarios, a quienes se les adosa ese otro bloque de sentido, aquel en abierta polémica con el logos imperial que expele a los individuos que no se dejan disciplinar. Con esto, entonces, se intensifica en ellos la insurrección y la diferencia con los disciplinados y posibilita la exploración de otros lugares/no-lugares, además de cartografiar “futuros parajes”, propicios para la asunción de (...) la nueva sociedad. Los locos de Arlt no son producto de una desadaptación social, sino de una adaptación a las condiciones alienadas de la sociedad bonaerense por la que circulan. Madness in Los siete locos is the result of an attempt of integration into reality that is experienced by revolutionary characters, to whom that other type of sense is added; one which is openly opposed to the imperial logo that expels individuals who do not let themselves to be disciplined. Thus, in these characters there is an intensification of the insurrection and distinction from those who are disciplined. This allows the exploration of other places/non-places and also helps to map “future settings” appropriate for the emergence of the new society. Arlt’s madmen are not the result of a social mismatch but of an adaptation to the alienated conditions of the Buenos Aires society that they are part of. (shrink)

El objetivo de este artículo es mostrar cómo la imagen que dio Manuel Chaves Nogales de la revolución rusa a través de sus artículos en los años treinta, siendo vanguardia del periodismo de entonces, tuvo un sentido histórico. La hipótesis es que el periodismo, informando sobre el presente, puede aportar a los historiadores alguna lección. Para mostrar la conciencia histórica del periodismo de Chaves Nogales se contextualiza al autor entre otros viajeros de la época a la Unión Soviética, se analiza (...) la manera en la que Chaves interpreta las huellas de la revolución en las personas y en su entorno y se relaciona con la microhistoria. This article canvases the main areas of controversy: the nature of Lockean signification and his position on propositions and particles.

Teachers in many countries complain that their pedagogic work is impeded by unreasonable bureaucratic demands by government agencies. This paper suggests that historical, institutional and cultural perspectives are needed to understand the processes at work. It draws on Weber’s classic study of bureaucracy, but also makes reference to claims that traditional bureaucracies have been modified in ways that ameliorate their authoritarian character. The central part of the paper examines the attempts of one country (Scotland) to address complaints about excessive bureaucracy: (...) it is argued that they show a limited understanding of the nature of institutional power. In the discussion that follows, a number of critical interpretations are considered: that bureaucracies are, by their very nature, anti-educational; that they undermine ethical consciousness and cause psychological damage; and that enhanced professionalism can serve as a counterweight to bureaucratic tendencies. The paper ends by suggesting that the powerful pragmatic argument that mass, state-run educational systems cannot function without complex administrative structures, should not be used to disguise the fact that they have unintended consequences, some of which tend to subvert their stated aims. On a currently popular reading of Locke, an idea represents its cause, or what God intended to be its cause. Against Martha Bolton and my former self (among others), I argue that Locke cannot hold such a view, since it sins against his epistemology and theory of abstraction. I argue that Locke is committed to a resemblance theory of representation, with the result that ideas of secondary qualities are not representations.

Se realizó un estudio cuantitativo-cualitativo con un diseño descriptivo, analítico e interpretativo, en el que se indagó si la investigación ocupa un espacio relevante en los treinta y cinco planes curriculares de las carreras profesionales de una universidad pública del Perú. Se constató, además, si se programaron competencias investigativas digitales. Finalmente, se analizó si la investigación formativa se encuentra inserta en los currículos. La muestra fue censal y como instrumento se aplicó una matriz de análisis de contenidos para recoger información (...) sobre las categorías establecidas previamente. Did the Thai Rak Thai Party of Thailand, the first party in the country’s history to gain parliamentary dominance in 2001, represent a departure from traditional clientelistic Thai parties or was it old wine in a new bottle? This article argues that the TRT represented a new hybrid party that successfully established programmatic linkages in rural parts of the country by systematizing its use of informal social networks in local communities. By routinizing recruitment, training, and evaluation of its parliamentary candidates (...) and their vote-canvassing networks, the TRT imparted midlevel politicians with the incentives and ability to promote the party’s policy agenda to rural voters and to cultivate new policy-oriented linkages alongside traditional clientelistic ones. By identifying specific organizational mechanisms by which the TRT combined programmatic and clientelistic linkages with rural voters, this study contributes to literature that examines hybrid party strategies as well as informal party organization. Like their contemporary counterparts, early modern philosophers find themselves in a predicament. On one hand, there are strong reasons to deny that sensations are representations. For there seems to be nothing in the world for them to represent. On the other hand, some sensory representations seem to be required for us to experience bodies. How else could one perceive the boundaries of a body, except by means of different shadings of color? I argue that Nicolas Malebranche offers an extreme -- (...) and ultimately unworkable -- attempt to solve this riddle. Most commentators claim that Malebranche defends an adverbial theory of sensation, according to which a sensation is merely a way in which an act of sensing happens. The adverbial reading is wrong, or so I argue. Once we arrive at a more accurate reading, we shall see that his position is much more strange than is currently thought. Nevertheless, Malebranche’s view is similar to the adverbial theory in one respect, albeit it at a very high level of generality. His view thus inherits two of the main problems that afflict adverbial theories. Although Malebranche fails to solve them, his ingenious attempts to do so are instructive. (shrink)

The conditions animals experience during the early developmental stages of their lives can have critical ongoing effects on their future health, welfare, and proper development. In this paper we draw on evolutionary theory to improve our understanding of the processes of developmental programming, particularly Predictive Adaptive Responses (PAR) that serve to match offspring phenotype with predicted future environmental conditions. When these predictions fail, a mismatch occurs between offspring phenotype and the environment, which can have long-lasting health and welfare effects. Examples (...) include metabolic diseases resulting from maternal nutrition and behavioral changes from maternal stress. An understanding of these processes and their evolutionary origins will help in identifying and providing appropriate developmental conditions to optimize offspring welfare. This serves as an example of the benefits of using evolutionary thinking within veterinary science and we suggest that in the same way that evolutionary medicine has helped our understanding of human health, the implementation of evolutionary veterinary science (EvoVetSci) could be a useful way forward for research in animal health and welfare.
